Volunteer Services:
Volunteer agrees to provide volunteer services to the Foundation as requested by the Foundation based on your identified availability. Such services may include, but are not limited to those listed on the volunteer sign up form and other optional duties as requested by the Foundation.
Term:
The term of this Agreement shall commence on the effective date and shall continue until terminated by either party upon written notice to the other party. We request that volunteers consider a commitment of at least one year.
Volunteer Status:
Volunteer acknowledges and agrees that nothing in this Agreement shall be construed to create an employer-employee relationship between Volunteer and the Foundation. Volunteer is an unpaid volunteer and is not entitled to any wages, benefits, or other compensation from the Foundation.
Volunteer Responsibilities:
Volunteer agrees to perform his/her duties diligently and in accordance with any instructions provided by the Foundation. Renewell does not provide computers, phones, or internet. Ethical online conduct is required. Volunteer also agrees to abide by all Foundation policies and procedures.
Liability Release:
Volunteer understands and acknowledges that the activities performed as a volunteer may involve certain risks and hazards. Volunteer hereby releases, waives, discharges, and covenants not to sue the Foundation, its directors, officers, employees, agents, and representatives (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Volunteer or any property belonging to Volunteer, whether caused by the negligence of the Released Parties or otherwise, while volunteering for the Foundation.
Indemnification:
Volunteer agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, including reasonable attorneys' fees, arising out of or related to Volunteer's acts or omissions while volunteering for the Foundation.
Insurance:
Volunteer acknowledges that the Foundation does not carry any insurance coverage for volunteers. Volunteer is solely responsible for obtaining and maintaining any insurance coverage necessary to protect Volunteer against any loss or injury arising out of Volunteer's activities as a volunteer.
Confidentiality:
Volunteer agrees to maintain the confidentiality of any proprietary or confidential information of the Foundation to which Volunteer may have access during the term of this Agreement. This includes in any online social media postings.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Collin County, Texas.
Entire Agreement:
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether oral or written, relating to such subject matter.
The parties agree that electronic signatures shall be considered valid and binding for all purposes under this Agreement. Each party may rely on electronic signatures as if they were original handwritten signatures. Electronic signatures may be executed and delivered in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. The use of electronic signatures shall have the same legal effect, validity, and enforceability as a signature affixed by hand. The parties agree not to contest the validity or enforceability of this Agreement based solely on the use of electronic signatures.
